Distance Selling postage refund...
Dear All,
Bought item by placing order over the phone Item delivered - DOA I returned item at my cost (Royal Mail Special Delivery, £7, paid Cash), based on retailers advice Replacement received - works fine Am I entitled to my £7 back from the retailer ? Cheers |

Incorrect, he is totally entitled under the SOG act to a full refund for return postage of the "not fit for purpose" item he returned. o You can actually request a company collect the item
---- this is under DOA etc o Many companies increasingly offer a RMA service ---- they just book a collection with their courier ---- usually the same one who DOA'd it in transit to you :-) The company should pay for /reasonable/ expenses in returning an item. Remember to sign courier receipts "not inspected" on delivery and cross out the "received in good condition". Saves a lot of hassle if physically broken. Company just sent a large delivery of flight case HPL plywood to me, cut to spec, but someone had used 5.5mm plywood and not the 6.5mm I requested. They admitted the error (unfortunate, since all specially cut) and collected it. In short, yes. You mentioned Distance Selling; don't get confused by a return under DSR with one under the Sale Of Goods Act. The retailer is liable for carriage under the DSR, *unless* they state otherwise in their T&Cs. Most do, stating the customer is responsible for return costs.
