Default U.S. Trade Representative: The U.S.-China JCCT: Outcomes on Major U.S. Trade Concerns

On April 21, 2004, Office of the U.S. Trade Representative issued a
press release "Trade Facts" outlining the conclusions of U.S.-China
Joint Commission on Commerce and Trade (JCCT) this year, in which
Chinese Vice Premier Ms. Wu Yi represented the Chinese government.

where the issues regarding WAPI and 3G are listed as follows:

With respect to its proprietary WAPI encryption standard for
wireless computer networks, China announced that it will:
- suspend indefinitely its proposed implementation of WAPI
as a mandatory wireless encryption standard.
- work to revise its WAPI standard, taking into account
comments received from Chinese and foreign firms.
- participate in international standards bodies on WAPI and
wireless encryption for computer networks.

With respect to third generation telecommunications standards
(3G) for mobile phones, China state that:
- it supports technology neutrality with respect to the
adoption of 3G.
- Telecommunications service providers in China will be
allowed to make their own choices as to which standard
to adopt, depending on their individual needs.
- Chinese regulators will not be involved in negotiating
royalty payment terms with relevant intellectual property
rights holders.

That Dick [Cheney] is one powerful mutha fu*ker. This concession
effectively renders China powerless in regulation bandwith within her
own sovereign territory. If this isn't economic imperialism I don't
know what is. And don't give me this bullsh*t about standards, read
below...

This effectively says China can not adopt European 3G celleur
standards, thus allowing US celleular manufacturs of other various
outdated "poperietary standards" to freely invade and fracture China's
celleular market. So much for the "need for standard" argument.
Clearly Dick's demands do not have China's best interest in mind.

What's next, Dick's gonna go to Japan and force Japanese to drop their
mad cow testing standard, on behalf of US beef industry?

Economic imperialism plain and simple, Dick.

No wonder this time People Daily and Xinhua don't dare to tell Chinese
people what kind of agreement Ms. Wu Yi signed and yielded to the US.
CCP still wanna Chinese people to know CCP made China strong.

The fact is CCP started a ridiculous policy on WAPI and found it is
not enforceable, lack support, and the deadline was too close after
announcement. This shows PRC government needs some good program
management people.

Read the three concession again by CCP:
- suspend indefinitely its proposed implementation of WAPI
as a mandatory wireless encryption standard.

Wu Yi aggree to this means now Beijing admit it is a mistake,
especially making it a mandatory one when an existing standard is
already there outside China.

- work to revise its WAPI standard, taking into account
comments received from Chinese and foreign firms.

This means Wu Yi agrees the WAPI policy was made "close door", not
even paying attention to domestic companies.

- participate in international standards bodies on WAPI and
wireless encryption for computer networks.

China cannot make its WAPI an international standard while classifying
it a "state secret".

Clearly CCP claims it is tough but actually weak. Sounds like a paper
tiger.

Let's see the three point:
- it supports technology neutrality with respect to the
adoption of 3G.

This means Beijing will not tell Chinese people what they can use. The
Chinese people can pick what standard they like.

- Telecommunications service providers in China will be
allowed to make their own choices as to which standard
to adopt, depending on their individual needs.

Again the same thing. The time for chinese communist party to decide
everything for Chinese is gone. Time for Chinese consumers to stand up
and decide what they need.

- Chinese regulators will not be involved in negotiating
royalty payment terms with relevant intellectual property
rights holders.

Time for Chinese government to do less and let private companies to do
more. The stage for communism is closing soon.

What's next, Dick's gonna go to Japan and force Japanese to drop their
