What! There is nothing there to change the situation. You have to return

your going to pay that cost.

This is wrong, the postage, in both directions, is the
responsibility of the vendor. Which bit of " bear any necessary
costs incurred in doing so (including in particular the cost of any
labour, materials or postage)." are you having difficulty
understanding?

The relevant bit of legislation is the Sale of Goods Act 1979
(as amended by SSGCR 2002) which came into effect on Mar 31st and
covers contracts entered into before that date.

Thanks. Just what I wanted to beat Ebuyer over the head with.

Are you saying that although Ebuyer are breaking the law Trading

Standards
will not be interested?

I'm saying there not breaking the law. I'm saying your interpretation is
wrong

No, you're the one who is mistaken. eBuyer has a responsibility to collect
or arrange for postage at the *their* expense (ebuyer's expense). If the
goods delivered are not fit for purpose or are faulty. Which they clearly
are in this case.

You just have to have me spell it out for you, don't you?

Due to lazy warehouse staff dropping items and then packaging them up
damaged or broken,

I've had more items badly packed from Dabs & Insight than any other e-
tailers, Ebuyer packages are always bursting with filling/packing.

due to where they purchase their stock from,

Computer2000, Ingram and the other main distis' etc. same as just about
every other major e-tailer

There is nothing stupid about my remark. I'm well aware tech items
fail, but ordering from ebuyer don't exactly help the consumer.

Your remark would appear less stupid (!) if you posted a source for your
information that ebuyer buy seagate drives from less reputable sources than
other suppliers, or that ebuyer send out more DOA seagate drives than other
suppliers.

Post the evidence.

Just one piece.

A reputable source.

Ebuyer buy Seagate drives from a dodgy source...
Ebuyer issue more DOA seagate drives than other vendors...

not heresay, not opinion, but facts.

nope?

didn't think you could.

Interesting now I'm back off holiday to see you are still misquoting law,
spouting unsubstantiated bull**** about ebuyer, and that comapnies like DABS
are continuing to grow at a phenomenal rate. Glad to be back to keep usenet
a more balanced place and not quite so full of self-indulgent, moronic,
unbelievably biased bull****.

Please dont reply with anything other than hard facts to support your
assertions about ebuyer and Seagate disk drives, and I do not regard your
website as a valid answer. I want figures from comparable vendors too
please, specifically about the purchase and supply of Seagate drives.

Ebuyer just offers 30 days warranty/replacement. Once it's over the
limit, you need to contact the maker directly.

Carp - retailer responsible as contract with them - however sometimes in
buyers interests to deal with Manufacturer- its the customers call - so
stop talking ****e

P.s. Ebuyer are a profit making company - you don't have to justify
their methods of improving their margins. Theoretically, the consumer
is meant to encourage a company to provide higher service levels whilst
demanding reductions in cost (i.e. margins). Therefore, concepts such
as refunds as well as replacements, return carriage / collection paid
for, etc. should be encouraged and requested. Your consumer influence
should be used to your advantage not just for improving the profits of
others and agrevating others (e.g. attacking ebuyerdotcon for trying to
improve things for everyone).

Has to be a balance in everything in life - make it too one sided and
consumer would lose in long run. Ebuyer.com may have had a point once
but its been lost amongst the constant false starts..

I have had a pop at their warehouse staff - but TBH never had the
slightest problem with any HDs from them.
