Default Too late to return?

Received an X1950GT on 2 Sept. Was returned on 5 Sept. Repaired, and
returned to me 10 Sept.

Now discover what I thought was a problem with my preceding card, is
probably a problem with my motherboard.

Would prefer to return the new card, even at the expense of a restocking
fee.

On what legal basis?

DSR? It looks like you have accepted the goods and started using them.

SOGA? It looks like the repaired/replaced card is fully-functional and
fault-free, so you can't return it as being faulty.

It's down to the goodwill of the company as to whether they will take it
back. I wouldn't have thought so, unless they replaced the card with a
brand new one and it is re-saleable as new and unused.

19th Sept today, yes unfortunately too late now.
Options - 1. ask the retailer if you can return it and pay a restocking fee.
2. ebay etc
